Child Support and Jail Time

Deadbeat parents can be criminally prosecuted in Illinois for non-payment of support.1 In some cases, the crime rates as a class A misdemeanor, but in many circumstances, it is prosecuted as a class 4 felony.2 Terms of imprisonment can exceed 8 years and fines (in addition to restitution) can exceed $25,000. Federal law also provides for criminal prosecution for non-payment of support whenever support for a child in another state goes unpaid for at least one year or arrears amount $5,000.3
