Property Purchased in Contemplation of Marriage
It's becoming less common, but sometimes a couple will buy a home just before their marriage – sometimes on the day of the marriage just before the ceremony. Technically, such property should be viewed as non-marital (it was acquired prior to the marriage) but many courts will ignore the technicality and conclude that the home, really, is marital property.1 Each case depends on its specific facts. Whether you'll gain by a finding that such property is marital or non-marital, be sure to call our office to work with an attorney who is familiar with the exceptions to the rule – you may save yourself a bundle of money.
