Saving the House – Injunctions Against Foreclosure

In some contentious and difficult cases, one spouse may seek to gain an advantage by not paying any of the bills – letting the utilities threaten disconnection and the bank to threaten foreclosure and sale of the marital residence. In some circumstances, the divorce court can enjoin the bank from further foreclosure proceedings1 and can force one spouse or the other to make the payments current.
