Saving the House – Injunctions Against Foreclosure
In some contentious and difficult cases, one spouse may seek to gain an advantage by not paying any of the bills – letting the utilities threaten disconnection and the bank to threaten foreclosure and sale of the marital residence. In some circumstances, the divorce court can enjoin the bank from further foreclosure proceedings1 and can force one spouse or the other to make the payments current. If you work with a knowledgeable and strong attorney you can avoid these problems to begin with. If, however, you find yourself falling behind financially, team up with an attorney who can help you take care of the bills, make your spouse pay a fair and reasonable share, and hold the creditors at bay – it's legal and effective.
