Marriage & Divorce
Divorces in Illinois come in a few flavors. Here is how they generally break down:
15% = Simple, Uncontested Divorce: Most folks have pretty simple, uncontested cases. A "simple" case is one where there are no outside issues — like a foreclosure or a mortgage refinancing, a pension to divide, bankruptcy, or a spouse in a foreign jurisdiction.
If your case has no outside issues and you already have your agreement worked out, you can use my Quick Online Divorce program. The program can handle kids, real estate, retirement accounts, everything:
You pay $500 + court costs;
You answer my questionnaire about your marriage and the terms of your agreement;
I file your papers with the court;
If you know where your spouse lives, your spouse must cooperate;
I schedule your court date and meet you in court;
You get divorced that day.
Easy-peasy. Most cases are done in a few weeks.
60% = Involved, Uncontested Divorce: Most couples agree that they want the divorce. Most couples have a vague idea of how they want to resolve issues about the children and divide assets and debts. Most couples do NOT discuss settlement terms in detail. They need help from a lawyer to spot other issues, understand the details of the law, understand how their lives will be impacted, and to get things cleaned up and squared away. There is no fighting in court and an agreement is resolved in a few weeks.
20% = Contested Divorce: This is like you see in the movies. If you're in this camp, you need to talk with a lawyer. Stop searching online and pick up the phone to schedule a consultation.
5% = Joint, Simplified Divorce: You and yours can walk down to the courthouse and get a divorce at minimal cost if you meet the qualifying criteria:
you both show up together in court
neither of you makes more than $20,000 / year
together you make less than $35,000 / year
you don't have kids and the wife is not pregnant
you've lived in Illinois for 90 days
You've been married less than 8 years
you've lived apart for at least 6 months
you don't own a house
you have a written agreement on all the terms, including who pays which debts and how to divide all property.
